Terms of Service

Welcome to CatchCast. These Terms of Service ("Terms") govern your access to and use of the CatchCast website and services at catchcast.ca ("Services"), operated by Braeden Klaver (doing business as CatchCast), based in British Columbia, Canada ("we", "us", "our").

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 13 years old to use CatchCast. By using the Services, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

2. Accounts

Certain features require an account. We use Clerk and Google Sign-In for authentication. You agree to:

  • Provide accurate information when registering.
  • Keep your account credentials secure and not share them.
  • Notify us immediately if you suspect unauthorized access.
  • Be responsible for all activity under your account.

You may delete your account at any time through your account settings or by emailing us. We may suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to:

  • Use the Services to advertise or offer to sell goods and services.
  • Sell, transfer, or share your account with another person.
  • Submit false, fabricated, or intentionally misleading fishing reports.
  • Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Services.
  • Use the Services to harass, abuse, or harm other users.
  • Scrape, harvest, or collect data from the Services in bulk without written permission.
  • Violate any applicable law or regulation.

4. User-Generated Content

CatchCast allows users to submit fishing reports and related content ("User Content"). You retain ownership of your User Content, but by submitting it you grant us a worldwide, non-exclusive, royalty-free license to display, store, and use that content to operate and improve the Services, including within public-facing community features.

You are solely responsible for your User Content. You represent that your User Content does not infringe any third-party rights and complies with these Terms. We reserve the right to remove any User Content at our discretion.

5. Fishing Conditions Disclaimer

CatchCast aggregates public data for informational purposes only. Fishability scores, flow data, weather data, and community reports are not guaranteed to be accurate, timely, or complete. You are solely responsible for:

  • Verifying conditions with official sources (Fisheries and Oceans Canada, Environment Canada, local authorities) before fishing.
  • Knowing and complying with all applicable fishing regulations, licences, and seasonal closures.
  • Your own safety while fishing, driving to fishing locations, or engaging in any related activity.

CatchCast is not a substitute for official regulatory information or your own judgment.

6. Our Content

The CatchCast name, logo, design, code, and non-user content are our exclusive property and protected by copyright, trademark, and other laws. You may not use them without our prior written permission.

7. Feedback

If you send us feedback or suggestions, you grant us the right to use that feedback without restriction or compensation.

8. Third-Party Services

The Services rely on third-party providers including Clerk (authentication), Vercel (hosting), Railway (backend hosting), Google (OAuth), and Cloudflare (DNS/email). Your use of those services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

9. Disclaimers

The Services are provided "as is" and "as available", without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability. We do not warrant that the Services will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by law, CatchCast and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Services.

Our total liability to you for any claim arising from these Terms or the Services will not exceed the lesser of (a) the amount you have paid us in the 12 months preceding the claim, or (b) CAD $100.

11. Indemnification

You agree to indemnify and hold harmless CatchCast and its operator from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Services, your User Content, or your violation of these Terms.

12. Copyright Infringement

If you believe content on CatchCast infringes your copyright, send a notice to hello@catchcast.ca including:

  • Identification of the copyrighted work claimed to be infringed.
  • Identification of the allegedly infringing material and its location on the Services.
  • Your contact information (name, address, email, phone).
  • A statement that you have a good-faith belief that the use is not authorized.
  • A statement, under penalty of perjury, that the information is accurate and you are authorized to act on the copyright owner's behalf.
  • Your physical or electronic signature.

We will respond in accordance with applicable Canadian copyright law (including the "notice and notice" regime) and may remove infringing material.

13. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any violation of these Terms or for any other reason. Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, Indemnification, and Governing Law) will survive.

14. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Services will be resolved in the courts located in British Columbia, and you consent to their exclusive jurisdiction.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page and post notice on the Services at least 7 days before the changes take effect, except for security fixes, bug fixes, or changes required by law or court order, which may take effect immediately. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.
